Terms of Service
Last updated:
These Terms of Service set out the rules for using the Tiqania website at https://tiqania.com and the general framework under which we offer our services. The website is operated by Tiqania (“we”, “us”, “our”); our company details appear at the end of this page. By using the website you agree to these terms. If you do not agree, please do not use the website.
1. Scope
These terms apply to everyone who visits the website or contacts us through it. They also describe, in general terms, how our digital products, custom software, AI and automation, and integration services are offered. They are not themselves an agreement to deliver any particular service.
2. Services and separate agreements
Descriptions of services on the website are for general information and do not constitute a binding offer. Each engagement is delivered under a separate written agreement or statement of work, and each subscription product is provided under its own product-specific subscription terms. Those documents define the scope, deliverables, timelines, fees and responsibilities of each party.
If there is a conflict between these terms and a separate written agreement, statement of work or product-specific subscription terms, the separate document prevails for the matters it covers.
3. Acceptable use
When using the website, you agree not to:
- use it in any way that breaches applicable law or the rights of others;
- attempt to gain unauthorized access to the website, its servers or any connected system;
- interfere with the normal operation of the website, including by introducing malicious code or placing an unreasonable load on it;
- collect content or data from the website by automated means in a way that harms its operation or misuses its content;
- submit false, misleading or unlawful information through our forms, or use them to send unsolicited messages;
- present yourself as acting on behalf of a person or organization without authority to do so.
We may restrict or block access where we reasonably believe these rules have been breached.
4. Intellectual property
The website and its content, including text, design, graphics, logos, software and the Tiqania name and marks, belong to us or to our licensors and are protected by applicable intellectual property laws. You may view the website and share links to it for legitimate business purposes. You may not copy, modify, republish or commercially exploit its content without our prior written permission.
Ownership of deliverables created for a client is determined by the agreement for that engagement, not by these terms.
If you send us ideas or feedback about the website, we may use them to improve it without obligation to you. This does not apply to confidential information exchanged under an agreement with us.
5. Website content
We work to keep the website accurate and up to date, but its content is provided for general information on an “as is” and “as available” basis. To the extent permitted by applicable law, we give no warranty, express or implied, that the content is complete, current or suitable for a particular purpose, or that the website will be uninterrupted or free of errors. Examples, case descriptions and results shown on the website are illustrative and are not a guarantee of any particular outcome. Please contact us before relying on website content for a business decision.
6. Limitation of liability
To the extent permitted by applicable law, we are not liable for indirect or consequential loss, or for loss of profit, revenue, data or business opportunity, arising from your use of, or inability to use, the website or its content.
Nothing in these terms excludes or limits liability that cannot be excluded or limited under applicable law. Liability relating to services we deliver is governed by the agreement for those services.
7. Third-party links
The website may link to websites or services that we do not operate. Such links are provided for convenience only. We do not control those websites and are not responsible for their content, availability or privacy practices. Their own terms apply when you use them.
8. Subscription products
We may offer subscription-based software products. When we do, the following applies together with the plan terms shown at the time of purchase:
- the price, billing period and plan features are shown before you confirm a purchase;
- fees are charged in advance for each billing period using the payment method you provide;
- subscriptions renew automatically at the end of each billing period unless cancelled before the renewal date;
- cancellation, renewal and refunds are governed by our Refund & Cancellation Policy;
- we may suspend or end access where fees remain unpaid or where the applicable subscription terms are breached, in line with those terms.
9. Privacy
Our handling of personal information is described in our Privacy Policy, and our use of cookies in our Cookie Policy.
10. Changes to these terms
We may update these terms from time to time. The date at the top of this page shows when they were last updated. The updated terms apply from the date they are published, and your continued use of the website after that date means you accept them. Changes to these terms do not alter a signed agreement between us unless that agreement says so.
11. Governing law
These terms are governed by the laws applicable in the jurisdiction where Tiqania is registered. We prefer to resolve any concern amicably, so please contact us first. Disputes that cannot be resolved in this way are subject to the competent courts under that law, unless a separate agreement between us provides otherwise.
12. Contact
If you have questions about these terms, you can reach us through the contact form at https://tiqania.com/en/contact.
